Dear Jennifer:
Thank you for taking the time recently to contact the Pintail Villas Board of Directors regarding the lemonade and cookie stand your children hosted in July. We understand your discontent over having to close the stand, and wish to respond to your concerns.
As you know, the Association Rules and Regulations prohibit solicitation on Pintail's property. Mrs. Schaeffer was under the impression that the rules extended to all forms of solicitation. Given her charge as President of the Board of Directors, she felt it was her responsibility to enforce the Rules and Regulations consistent with her interpretation of the Rules.
Following receipt of your letter, we requested an opinion from Pintail's legal counsel, who has assured us that hosting a lemonade stand would not fall within the definition of solicitation. Furthermore, we received confirmation that a lemonade stand held by an individual homeowner in a common area on Pintail Villas would not expose the Association to liability. While we doubt any significant issues would ever arise, we trust you can appreciate that it is our duty to act in the best interest of the Association as a whole.
That said, please accept our sincere apologies for the misunderstanding on July 22, and regret any inconvenience brought to your family. We hope it will not deter your children from similar endeavors in the future.
